Collaborative Law Process

Collaborative law differs from mediation because the parties and their respective attorneys must sign an agreement not to litigate the dispute issue. If the legal issue cannot be resolved in the collaborative law process, the attorneys must all withdraw from the case when the issue goes to court.

The idea behind the signed agreement is that there is a greater incentive to stay engaged in the discussions and work harder to resolve the issue collaboratively.
